Public consultation regarding the Terms and conditions for Balance Responsible Parties in the Luxembourg scheduling area in accordance with Article 18 of Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing system

Public consultation from 18 June to 23 July 2025

Introduction:

The Commission Regulation (EU) 2017/2195 of 23 November 2016 establishing a network code on electricity balancing (hereinafter referred to as the « EBGL Regulation ») entered into force on 18 December 2016.

The terms and conditions for Balance Responsible Parties have been established by Creos Luxembourg SA (hereinafter "Creos"), the Luxembourg transmission system operator (hereinafter "TSO"), in accordance with Article 18 of Commission Regulation (EU) No 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing, as amended.

The present consultation refers to the terms and conditions for Balance Responsible Parties (BRPs).

The proposition of the terms and conditions applicable for Balance Responsible Parties include:

  1. Definition of balance responsibility for each connection in a way that avoids any gaps or overlaps in the balance responsibility of different market participants providing services to that connection
  2. Requirements for becoming a Balance Responsible Party
  3. Requirement that all Balance Responsible Parties shall be financially responsible for their imbalances, and that the imbalances shall be settled with the connecting TSO
  4. Requirements on data and information to be delivered to the connecting TSO to calculate the imbalances
  5. Rules for Balance Responsible Parties to change their schedules prior to and after the intraday energy gate closure time pursuant to paragraphs 3 and 4 of Article 17 of the EBGL Regulation
  6. Rules for the settlement of balance responsible parties defined pursuant to Chapter 4 of Title V of the EBGL Regulation
  7. Delineation of an imbalance area pursuant to Article 54(2) of the EBGL Regulation and an imbalance price area
  8. Maximum period for the finalisation of the settlement of imbalances with balance responsible parties for any given imbalance settlement period pursuant to Article 54 of the EBGL Regulation
  9. Consequences in case of non-compliance with the terms and conditions applicable to balance responsible parties
  10. Obligation for balance responsible parties to submit to the connecting TSO any modifications of the position
  11. Settlement rules pursuant to Articles 52, 53, 54 and 55 of the EBGL Regulation

Consultation period:

Creos invites all parties to submit their comments and suggestions on the documents submitted for consultation and information, and to indicate, where applicable, which information is confidential.

The consultation period runs from 18 June 2025 to 23 July 2025 (6 p.m.).

After the consultation period, Creos will analyse and incorporate the contributions into a consultation report with Creos' responses to the comments. The consultation report, including confidential information, will be sent to the Luxembourg Regulatory Institute (ILR). Creos will publish the consultation report on its website with confidential information redacted.

Information session:

An information session via TEAMS is scheduled as part of the public consultation.

The information session is planned for:
